Sentit Terms of Service

Use of our service

The terms governing your use of the sentit.io website (www.sentit.io) and its interface ("Sentit" or "Sentit wallet"), software, services, mobile applications, and any other application, software, services, websites, and other related services provided by Sentit Technologies LLC, its subsidiaries, and affiliates ("sentit.io", "Sentit", "us", "we", and "our") or any third party designated by us (collectively, with the Website, the "Service(s)") are (collectively, the "Terms").

These Terms and any documents linked to in these Terms constitute a legally binding agreement between you and Sentit. By accessing this User Agreement or using the Services, or otherwise indicating your acceptance of these Terms, you represent and warrant that:

You are an individual who is at least 18 years old and can enter into this User Agreement and agree to be legally bound by the terms and conditions of this User Agreement and all of the Terms;
If you are a corporation, government entity, or other legal entity, you have the right, power, and authority to enter into this User Agreement; and
You may not access or use the Services if you do not accept the Terms.

Term modifications

We reserve the right to edit, alter, or modify these Terms at any time, for any reason, and at our sole discretion, by posting an updated version of this document. Any such modifications will become effective when posted on sentit.io or when you utilize the services.

If you have given us your email address, we may notify you via email of any changes or updates.

If you continue to use the services after such a change or modification, you will be believed to have read, comprehended, and unreservedly agreed to the changes. If you have not read, understood, or unreservedly agreed to the changes or adjustments, you must immediately stop using our services and close your account. Please carefully read the terms and revisit this page occasionally to review the User Agreement.

Privacy policy

Please review our Privacy Statement for details on how we collect, utilize, and share your information. The collected information and/or data will be used and stored in accordance with our Privacy Policy. Sentit may periodically amend the Privacy Policy. You are responsible for reviewing the Privacy Policy.

Sentit account conditions

You may be required to give information about yourself as part of the registration process for the Services or as part of your continued usage of the Services in order to access certain Services. To establish an account with us, a valid email address and password are required ("Account"). You acknowledge that you are responsible for preserving the secrecy of your password and other account information, including the security and privacy of any cryptoasset keys. You agree that you will not share your login credentials with any third party and that you will not hold Sentit liable for any activities undertaken by unauthorized users with access to your account. Consequently, you acknowledge that you are solely responsible to Sentit for all activity that occurs under your Account and that Sentit is not liable for any issues with your Account resulting from the misuse or loss of your email address, bitcoin keys, and/or password.

There are various prerequisites for the establishment, maintenance, and deletion of an account:

Accounts created using "bots" or other automatic means are prohibited.
Sentit may send you account-related updates to the email address you supplied during registration. You agree and recognize that Sentit is not liable for any harm you may suffer as a consequence of your failure to receive any notice supplied to you in connection with this User Agreement and your use of the Services, provided that such notice was sent to the email address connected with your Account.
To create an account, you must be at least 18 years old. We do not knowingly allow anyone under the age of 18 to use our services.
You may close your account at your sole discretion at any time. You are responsible for properly cancelling your account using the Sentit website. Closing your account may not result in the complete erasure of your personal information. Some data may be preserved in encrypted backups. This information is irretrievable once your account has been terminated.
After closing your account, you are still responsible for all transactions that occurred while it was active.
You agree and understand that Sentit reserves the right, at our sole discretion, to immediately suspend, freeze, or terminate your account if you are suspected of having violated any provision of this User Agreement, if you are suspected of violating applicable law, or if you are suspected of engaging in activities or conduct harmful to Sentit.

User assertions and guarantees

By utilizing our services and, in particular, the Sentit wallet software, you represent and warrant that you recognize, comprehend, and accept the following risks:

The Sentit wallet is available to you by Sentit Technologies LLC, a commercial business unaffiliated with the Stellar Development Foundation. Sentit Wallet is merely an interface to the Stellar Network and does not operate the Stellar Network. Sentit Wallet is not a trading platform. The Sentit wallet cannot regulate the actions of other Stellar network participants. When utilizing the Sentit wallet, you communicate directly with the Horizon Stellar API and the Stellar network, which is controlled by a decentralized network of trusted organizations hosting validators.
When you create a Stellar wallet ("Stellar account"), the Sentit wallet software generates a cryptographic public and secret key pair that you may use to transfer and receive any supported cryptoasset on the Stellar Network.
You are solely responsible for preserving a backup of your Stellar account, secret key, and transaction information that you retain in your Sentit Wallet or otherwise with the Services outside of the Services. If you do not maintain a backup of your Stellar account secret key outside of the Services, you may lose access to any supported cryptoasset previously accessed using your Sentit wallet if we discontinue or no longer offer some or all of the Services, or you may otherwise lose access to any supported cryptoasset. We are not responsible for preserving these records for you. Using blockchain explorers, transactions and Stellar account information can be accessed as public information on the Stellar Network.
The Sentit wallet is not a custodian of your Stellar lumens or any Stellar Network-issued cryptoassets. We have no access to your tokens, cryptocurrencies, private keys, or account passwords. The Sentit wallet can only support Stellar Lumens and other Stellar Network-issued cryptocurrencies. Under no circumstances should you attempt to store an asset that Sentit Wallet does not support, regardless of whether it is money, commodity, security, utility token, or any sort of asset.
Any virtual currency transaction created with the wallet must be confirmed and logged in the Stellar Network's cryptocurrency ledger in order to be finalized.
Sentit has no control over the Stellar Network and consequently cannot and will not guarantee that the Stellar Network will confirm any transaction data you provide via our services. You accept and acknowledge that the Stellar Network utilized to process the transaction may not finish the transaction details you submit via our Services, or may do so with significant delay.
Once transaction details have been uploaded to the Stellar Network, we are unable to help you cancel or change your transaction or transaction details. Sentit.io has no control over the Stellar Network and is therefore unable to enable cancellation or modification requests. All Stellar Network transaction requests are irrevocable.
Sentit has a minimal fee for its wallet to receive, send, or control supported Stellar Network-issued cryptocurrencies. However, we reserve the right to increase this in the future, at which point any applicable fees will be displayed prior to your incurring them. A transaction may incur Stellar Network-required network costs in order to complete. We may attempt to compute this fee on your behalf. It is possible that our calculation is either insufficient or excessive. You are exclusively responsible for paying such fees, and Sentit will neither advance nor fund them on your behalf nor will it be liable for any excess or insufficient charge calculation.
You must assume all risks associated with: (i) safeguarding and storing your cryptoassets, tokens, and secret keys; (ii) auditing the quality, security, value, and merit of the assets you transact; (iii) auditing the legality and legal compliance of your transactions of all assets with any counterparties; (iv) auditing counterparties with whom you establish a trust line; and (v) using the Services to perform any operation or transaction.

No endorsements

Asset listings on Sentit Wallet are not endorsements. The Sentit Wallet is ONLY a software client and DOES NOT perform independent due diligence or assessment of any asset released on the Stellar Network.

Stellar is an open system, so fraud and market manipulation are possible. The prices displayed on the Sentit wallet or within the services are for informational purposes only and do not imply that they can be redeemed for a specific price.

Sentit has no influence over the creation, operation, management, marketing, or any other activity of any of the assets listed on sentit.io or otherwise made accessible via the service and Sentit wallet.

Any asset-related information shown on the sentit.io website or otherwise made available through the service is sourced from the community and may be insufficient or wrong.

Risk aspects with cryptocurrencies

Assets denominated in cryptocurrencies are susceptible to severe market risks and volatility.

By accessing this User Agreement or using the Services, you agree and acknowledge that there are risks associated with using Services involving Virtual Currencies, including but not limited to, the risk of failure of hardware, software, and internet connections; the risk of failure to achieve a certain market value/price for any cryptoasset issued on the Stellar Network; the risk of malicious software introduction; and the risk that third parties may obtain unauthorized access to your account information.

You acknowledge and agree that Sentit is not liable for any communication failures, interruptions, mistakes, distortions, or delays you may encounter while using the services.

You understand and recognize that there are dangers connected with using any network for virtual currency, including but not limited to the possibility of unknown vulnerabilities or unanticipated modifications to the network protocol. You recognize and agree that Sentit has no control over the Stellar Network and is not liable for any harm resulting from such risks, including, but not limited to, the inability to reverse a transaction and any losses incurred as a result of incorrect or fraudulent activities.

The risk of loss associated with utilizing services involving cryptoassets may be high, and losses may arise rapidly. The price and liquidity of other cryptoassets issued by the Stellar Network are susceptible to substantial variations. Past performance is not indicative of future results. Before engaging in cryptoasset trading, you must conduct research and be cautious.

You acknowledge and understand that Sentit is not liable for your investment losses.

Acceptable use

You acknowledge that you are solely responsible for your behaviour when accessing or utilizing the services. Without limiting the generality of the foregoing, you agree not to:

Use the Services in any way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functionality of our Services in any way;
Use the Services to pay for, support, or indulge in any illegal activities, including illegal gambling, fraud, money laundering, or terrorist activities;
Use any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access our Services or to harvest data;
Use or attempt to use, without authorization, another user's wallet or credentials;
Attempt to circumvent any content screening mechanisms we employ or to access any service or area of our Services to which you are not allowed;
Introduce to the Services any virus, Trojan, worms, or other harmful content;
Develop any third-party applications that interact with our Services without our prior written consent;
Provide false, inaccurate, or misleading information; or
Encourage or induce any other person to engage in any of the activities prohibited by this Section.

The protection of intellectual property and content

Unless otherwise specified, all intellectual property rights and content provided in conjunction with our services belong to Sentit or our licensors or suppliers and are protected by relevant intellectual property laws. No implied permission is granted for the use of the material on the services.

You accept and recognize that the material and content accessible through our Services are made available solely for your personal, lawful, noncommercial use and that you may only use such material and content for the purposes of utilizing the Services.

You further acknowledge that any other use of content from the Services is strictly prohibited, and you undertake not to violate or assist others in violating our intellectual property rights. You agree to keep all copyright and other proprietary notices contained in the material delivered through our services on any copy you make of the material; however, failure to do so will not affect Sentit's intellectual property rights therein.

You may not sell or modify materials generated or made through our Services, nor may you reproduce, display, publicly perform, distribute, or otherwise use the materials for any commercial or public purpose. Any use of the materials on another website, file-sharing service, or similar platform is strictly banned. Without our express written consent, you may not reproduce any content or material obtained from or created using our services.

Sentit reserves all rights not expressly granted herein to utilize the materials available on or through its services.

Independent goods and services

You may view content or services supplied by third parties while using the services, including links to their web pages and services ("Third Party Services"). These third-party services are offered exclusively for your convenience. We have no authority over third-party services and assume no responsibility for them. Your use of these third-party services is governed by the terms and conditions or privacy policies of the respective party.

You are responsible for reviewing the terms and privacy policies of any third-party services that you visit or use. You acknowledge and accept that we are not responsible or liable for any loss or damage of any kind incurred as a result of such dealings and that your use of third-party services is at your own risk.

Accuracy of Information

We shall make reasonable attempts to check the accuracy of any information displayed, supplied, passing through, or originating from the services, but such information may not always be correct or up-to-date. Therefore, you should independently check all information before relying on it, and you are solely responsible for any decisions or actions you take based on such information.

You acknowledge and agree that we make no representations or warranties of any kind, express or implied, statutory or otherwise, regarding the contents of the Services, information and functions made accessible through the Services, any hyperlinks to third-party websites, or the security associated with the transmission of information through the Services or any website linked to the Services.

Regulatory responsibility for law compliance

You alone are responsible for ensuring compliance with local laws and taxes. In your area, cryptocurrencies may be prohibited. By engaging in this User Agreement, you agree to comply with all applicable laws and be legally bound by them. Sentit is not required to check your compliance with the law.

Disclaimers of liability

Utilization of the services is at your own risk. Sentit offers the services "as is" and "as available" with no express or implied warranty. We disclaim expressly, and you waive, all warranties of any kind, whether express, implied, or statutory, regarding the Services, Sentit wallet, Sentit, or any XLM granted to you by us, including, without limitation, any warranties of merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement.

You acknowledge that the information you store or transfer through our services may become irretrievably lost or corrupted or temporarily unavailable due to a variety of causes, such as software failures, protocol changes by third-party providers, internet outages, force majeure events or other disasters, including third-party DDoS attacks, scheduled or unscheduled maintenance, or other causes either within or outside of our control. You accept complete liability and risk of damage resulting from your use of the services or any software, information, content, or other material accessed from the services. You undertake full liability and risk of loss for all transactions and trades conducted using the services. You are solely responsible and liable for the safe storage, retrieval, and use of your cryptoasset secret keys on the Services.

Limitation of Responsibility

You acknowledge and agree that we will not be liable to you or any third party for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the Services; any breaches of your account by hackers; any modification, change, suspension, discontinuance, malfunction, delay, or interruption of the Services; any reimbursement programs or any award programs; the Services in general; or the software or systems that support the Services.

You agree to take on all the risks and responsibilities that come with using us or our services.

Indemnification

You agree to protect Sentit, its affiliates, subsidiaries, directors, managers, members, officers, and employees from any claims, demands, actions, damages, losses, costs, or expenses, including reasonable legal fees, that come from or are related to your or someone else's use of your credentials or account in connection with: (a) using the Services; (b) breaking this User Agreement or any other policy; (c) feedback or submissions.

Government regulation

Without regard to conflicts of laws principles, this User Agreement and any claim or controversy arising out of or relating to this User Agreement, the Services, or your use of the Services, will be governed by and construed in accordance with the laws of the jurisdiction where Sentit is registered. You agree to personal jurisdiction and venue in the courts of that jurisdiction.

Modification of terms

Sentit reserves the right to modify or replace any of the terms of this User Agreement at any time. The most current version of this User Agreement will be posted on the Sentit website. You are responsible for regularly reviewing this User Agreement. Continued use of the Services after any such changes shall constitute your consent to such changes.

Termination

Sentit reserves the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the User Agreement. All provisions of the User Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Entire agreement

This User Agreement, together with any other legal notices and agreements published by Sentit on the Services, shall constitute the entire agreement between you and Sentit concerning the Services. If any provision of this User Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this User Agreement, which shall remain in full force and effect.
